Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Post Minion (“we,” “us,” or “our”), available at www.postminion.com (the “Service”). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or 16 years old in the European Economic Area) to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:
- Notify us immediately of any unauthorized use of your account.
- Not share your account credentials with any third party.
- Not create accounts for the purpose of circumventing usage limits or violating these Terms.
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Subscriptions and Billing
a. Paid Plans
Access to post creation and scheduling features requires an active Pro subscription. Subscription fees are charged monthly in advance. Payments are processed by Dodo Payments and are subject to their terms of service.
b. Free Trial
We may offer a free trial period at our discretion. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.
c. Cancellation
You may cancel your subscription at any time through the billing portal (User Settings → Subscription & Billing → Manage Billing). Cancellation takes effect at the end of the current billing period. You retain access to paid features until the period ends. We do not provide prorated refunds for partial months.
d. Price Changes
We reserve the right to change subscription prices. We will notify you of any price changes at least 30 days in advance via the email address on your account. Your continued use of the Service after the price change takes effect constitutes acceptance of the new price.
e. Usage Limits
Your plan includes a monthly post limit. Unused posts do not carry over to the next billing period. Exceeding the limit may prevent you from creating additional posts until the next billing period begins.
4. Acceptable Use
You agree not to use the Service to:
- Publish content that is unlawful, defamatory, harassing, abusive, fraudulent, infringing, obscene, or otherwise objectionable.
- Violate the terms of service, community guidelines, or policies of any connected social media platform (Instagram, TikTok, YouTube, Threads, Facebook, LinkedIn).
- Distribute spam, unsolicited messages, or misleading content.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Engage in any activity that interferes with or disrupts the Service or its servers and networks.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use the Service to collect or harvest personal data about other users without their consent.
- Circumvent any access controls, rate limits, or security measures of the Service.
We reserve the right to remove any content and suspend or terminate accounts that violate this section, without notice or refund.
5. Social Media Platform Compliance
The Service connects to third-party social media platforms via their official APIs. You are solely responsible for ensuring that the content you publish through Post Minion complies with the applicable terms, policies, and community guidelines of each platform. We are not responsible for any suspension, ban, or penalty imposed on your social media accounts by those platforms.
You authorize Post Minion to access your connected social media accounts solely for the purpose of publishing and scheduling content on your behalf, as directed by you.
6. Your Content
You retain all ownership rights in the content you create and upload through the Service (“Your Content”). By uploading or submitting content, you grant Post Minion a limited, non-exclusive, royalty-free license to store, process, and transmit Your Content solely to provide the Service (e.g., storing media files in Google Cloud Storage, publishing posts to your connected accounts on your instruction).
We do not claim ownership of Your Content, and we will not use it for any purpose beyond operating the Service. You are solely responsible for the accuracy, quality, and legality of Your Content.
7. Intellectual Property
The Service, including its software, design, logos, trademarks, and all content produced by Post Minion, is owned by us and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand names without our prior written consent.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.
9. Third-Party Services
The Service integrates with third-party services including social media platforms, Dodo Payments (billing), Google Cloud Storage (media storage), and Brevo (transactional email). Your use of those services is subject to their own terms and privacy policies. We are not responsible for the practices of third-party services.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
We do not guarantee that posts scheduled through the Service will be published on time or at all; delivery is subject to availability of the relevant social media platform APIs and factors outside our control.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POST MINION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Post Minion and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party right, including any intellectual property right or privacy right.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) shall survive.
You may delete your account at any time from User Settings → Account → Delete Account.
14. Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you by email or via a notice in the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
15. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction, as agreed by the parties.
